Welcome to MediaTranscriber.com. By using our audio and video transcription services, you agree to be bound by these Terms & Conditions. Please read them carefully before using our services.

1. Service Description

MediaTranscriber.com provides automated audio and video transcription services designed for YouTubers, podcasters, and content creators. Our service uses advanced artificial intelligence technology to convert spoken content into written text, with automatic speaker identification and timestamps.

1.1 Core Features

Our service includes:

• Transcription: Accurate speech-to-text conversion in 56+ languages
• Speaker Identification: Automatic detection and labeling of different speakers
• AI Tools: AI-powered transcript cleanup, title suggestions, show notes, social media posts, bullet point summaries, and chapter markers
• Translation: Translate transcripts to 56+ languages
• Export: Download transcripts in multiple formats (PDF, DOCX, TXT, SRT)

1.2 Video File Processing

When you upload a video file, the audio track is automatically extracted for transcription. You can choose to enable video features per episode, which retains the original video and allows chapter-based clip generation, downloads. If video features are not enabled, only the extracted audio is retained.

1.3 Podcast Archive Service

Our podcast archive service allows you to transcribe your entire podcast catalog and automatically transcribe new episodes as they publish. This includes:

• RSS Feed Integration: Connect your podcast's RSS feed to import episodes
• Archive Transcription: One-time transcription of your entire back catalog
• Auto-Transcription: Automatic transcription of new episodes (subscription required)
• AI-Powered Search: Search across all your episodes using keywords or AI questions
• Public Search Pages: Optionally share a searchable page with your audience

1.4 Podcast Audio Storage and Compression

IMPORTANT: When you add a podcast to our service, episode audio files are downloaded and stored on our servers as a backup copy. To optimize storage costs and service sustainability, audio files are automatically converted to a compressed format (mono MP3 at 64kbps).

This compression process may affect audio quality. While the compressed audio retains good quality suitable for playback and reference, it may not match the original audio file's quality. The compressed audio is:

• Suitable for listening, review, and reference purposes
• Sufficient for accurate transcription and playback in our interface
• Not intended as a master archive or replacement for your original files

You should always maintain your own backup copies of original, uncompressed audio files. We are not responsible for any loss of audio quality resulting from this compression process.

2. Acceptance of Terms

By uploading files to our service, creating an account, or making a payment, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our services.

3. User Responsibilities

3.1 Content Ownership

You represent and warrant that you own or have the necessary rights and permissions to upload and transcribe the audio/video content you submit. You are solely responsible for ensuring that your use of our service does not infringe on any third-party rights.

3.2 Prohibited Content

You agree not to upload content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights of others
• Contains illegal material or promotes illegal activities
• Is defamatory, threatening, or harassing

3.3 Archiving Responsibility

You are solely responsible for downloading and archiving your transcriptions and generated assets. Our service provides temporary storage for your convenience, but transcriptions, associated audio files, and retained/generated video files are automatically deleted after the retention period (7 days for standard storage, or 1 year with the relevant storage add-on). We strongly recommend downloading important files immediately upon completion.

4. Payments and Refunds

4.1 Secure Payments

All payments are processed securely through Stripe, a PCI-DSS compliant payment processor. We do not store your credit card information on our servers. Your payment details are transmitted directly to Stripe using industry-standard TLS encryption.

4.2 Pricing

Transcription pricing is based on the duration of your audio/video file. Current pricing is displayed on our Pricing page. Prices may be subject to change, but any changes will not affect purchases already made.

4.3 Volume Packs

Prepaid volume packs are non-refundable. Minutes purchased in volume packs are valid for 1 year from the date of purchase and cannot be transferred or exchanged for cash.

4.4 Extended Storage

Extended storage is available as separate account-level add-ons for audio and video. Audio storage covers transcripts and transcription audio files. Video storage covers retained original videos and generated video clips. Each add-on extends retention for the relevant asset type for 1 year from the date of purchase. Storage add-ons are non-refundable but renewable.

If you have an active extended storage subscription and you add a podcast (subscribe to a podcast plan), the remaining value of your extended storage is applied as a credit to your first podcast archive payment and your extended storage is then invalidated. Podcast data is retained only while your podcast subscription is active; if you cancel or your subscription ends, podcast transcriptions and associated data are removed 7 days after the subscription period ends, even if you had previously purchased extended storage (because that value was applied as credit and invalidated).

4.5 Podcast Subscriptions

Podcast subscription plans provide automatic transcription of new episodes. Subscriptions are billed monthly and include a set number of episodes per month and AI search credits. If your podcast's publishing frequency consistently exceeds your plan's episode limit, automatic transcription may be paused until you upgrade your plan.

4.6 Public Search Packs

Public search packs allow visitors to search public podcast archives. Credits are tied to the email address used at purchase and do not expire. Credits are non-refundable and non-transferable.

4.7 Refunds for Failed Transcriptions

If a transcription fails after payment and cannot be recovered, you may request a full refund or retry the transcription at no additional cost. Automatic refunds are processed through Stripe and typically appear on your statement within 5-10 business days.

4.8 Reasonable Use – Subscription Storage

Podcast subscription plans include storage for your transcribed episodes as part of normal podcast use. We expect most subscribers to use our service for their podcast content in a typical manner. If your use is unusual (for example, importing an exceptionally large archive combined with high-volume automated access), we may contact you to discuss your needs. This clause is intended to address rare abuse or edge cases, not normal heavy use by active podcasters. We will not require you to delete any content; we only ask for a conversation if usage appears outside the scope of typical podcast operation.

5. Privacy and Data Handling

5.1 File Processing

Your uploaded files are processed using OpenAI's transcription technology. Files are transmitted securely and are only used for the purpose of generating your transcription. We do not use your files or transcriptions for training AI models or any other purpose.

5.2 AI Tools

Our AI-powered tools (title suggestions, show notes, social media posts, summaries, and translations) use your transcript content to generate helpful outputs. This content is processed by OpenAI's language models. Generated content is cached to improve performance but is deleted when your transcription expires. You retain full ownership of all AI-generated content based on your transcripts.

5.3 Data Retention

Your files and transcriptions are stored temporarily on our secure servers. Standard retention is 7 days from completion, after which files are permanently and automatically deleted. Audio and video retention can be extended with their respective storage add-ons (see Section 4.4).

5.4 Account Deletion

Upon account deletion, all your data is anonymized and your transcriptions, associated audio files, retained videos, generated clips, and related metadata are permanently deleted. This action cannot be undone. We retain minimal anonymized data for legal and accounting purposes only.

5.5 Data Security

We implement industry-standard security measures to protect your data, including encrypted file storage, secure HTTPS connections, and access controls. However, no system is 100% secure, and you acknowledge the inherent risks of transmitting data over the internet.

6. Limitation of Liability

6.1 No Guarantee of Accuracy

IMPORTANT: While we strive to provide accurate results, our service uses automated AI technology that may produce errors. We do not guarantee the accuracy of transcriptions, translations, or any AI-generated content (including titles, show notes, social media posts, summaries, or chapter markers).

You are solely responsible for reviewing, verifying, and correcting all output before use. This is especially critical when accuracy matters for:

• Legal, medical, financial, or official documents
• Published content, articles, or public communications
• Captions or subtitles for accessibility purposes
• Any context where errors could cause harm or liability

By using our service, you acknowledge that all transcriptions, translations, and AI-generated content require human review and that you accept full responsibility for the use of this content.

6.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to our services. We are not liable for any temporary unavailability due to maintenance, technical issues, or circumstances beyond our control.

6.3 Data Loss

IMPORTANT: We are not liable for any loss of files, transcriptions, or data. This includes, but is not limited to, losses due to:

• Technical failures or system errors
• Automatic expiration and deletion of files
• User error or failure to download files before expiration
• Third-party service outages (including AI providers)
• Security breaches or unauthorized access
• Force majeure events

You acknowledge that you are solely responsible for maintaining backup copies of your original files and downloading your transcriptions before they expire.

6.4 Maximum Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of our service shall not exceed the amount you paid for the specific transcription that is the subject of the claim.

7. Intellectual Property

You retain all rights to your original content and the transcriptions generated from it. We claim no ownership over your content. The MediaTranscriber.com service, including its design, features, and technology, remains our intellectual property.

8. Changes to Terms

We may update these Terms & Conditions from time to time. Material changes will be communicated to registered users via email. Continued use of our service after changes constitutes acceptance of the new terms.

9. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of Norway. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of Norwegian courts.
